Deb (Gupta), learned counsel appearing for the petitioner being satisfied by the clarification given by Mr. Samarendra Das, Executive Officer, Tripura State Co-operative Union, who issued the communication under No. F. 1(82)/TSCU/99/1177-78 dated 10. 02. 2020 has submitted that if the due gratuity and the leave salary are released, the petitioner will not pursue the matter. This court has also heard Mr. Samarendra Das, Executive Officer, Tripura State Co-operative Union and he has given an undertaking before this court that within thirty days from today, the said amount, as due to the petitioner, shall be released and paid. Mr. R. Chakraborty, learned counsel appearing for the respondents No.
3, 4 & 5 has not advanced any argument in respect of the submission made by Mr. Das, Executive Officer, Tripura State Co-operative Union- the respondent No. 1. Mr. R. Saha, learned counsel appears for the respondents No. 1 & 2 whereas Mr. P. Saha, learned counsel appears for the respondents No. 6 & 7. In view of the decision taken by the Tripura State Co- operative Union as expressed in the communication dated 10. 02. 2020 this writ petition has become infructuous. (C)No. 709 of 2018 I am to inform you that this establishment has already sanctioned your clamed as admissible of Gratuity and Leave Salary and shortly it will be pay to you.
