The petitioner is apprehending his arrest in connection with Giridih Town P. S. Case No. 33 of 2025, registered for the offence under Section 96 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Giridih. 3.
Learned counsel appearing for the petitioner submits that in the FIR, the allegations are made of taking away the girl of the informant, however, later on the petitioner and the girl of the informant have solemnized the marriage in the office of District Sub-Registrar, Giridih and the certificate to that effect has been annexed as Annexure- 2 of the petition. 4. Learned A. P. P. appearing for the State has opposed the prayer and submits that the allegations are there of taking away the girl of the informant forcibly. 5. Learned counsel appearing for the informant accepts the submission of learned counsel appearing for the petitioner and submits that the marriage has been solemnized between the petitioner and the -1-girl of the informant and they are residing happily. 6.
Annexure-2 is the document, which clearly suggests that petitioner and the daughter of the informant have solemnized the marriage in the office of District Sub Registrar, Giridih and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Giridih Town P. S. Case No. 33 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J. ) Dated:-05. 05. 2026 Amitesh/- -2-
