Item No. 2 IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 629 of 2020 Sarangthem Mani Chenglei. …Petitioner - Versus - State of Manipur & 2 Ors. …Respondents (VIDEO CONFERENCE) B E F O R E HON’BLE MR. JUSTICE KH. NOBIN SINGH O R D E R 17-12-2020 [1] Heard Shri I. Denning, learned Advocate appearing for the petitioner. [2] By the instant writ petition, the petitioner has prayed for issuing a writ of certiorari or any other appropriate writ to direct the respondents to clarify the contradiction between the Government orders dated 30-12-2020 and 04-09-2018 by way of consideration of the representation dated 29-09-2020. [3] According to the petitioner, after a long litigation in different Courts and various orders being passed therein including the order dated 07-08-1998, the respondents issued an allotment order dated 30-08-2010 in favour of the petitioner and seventeen others in compliance with the said orders.

[4] The Under Secretary (Revenue), Government of Manipur vide its letter dated 18-08-2020 addressed to the Director (Settlement & Land Records), Government of Manipur fixed a premium amount @ Rs. 25,53,610/- only. In the said order, it has been stated that the same was issued as per the directions of the Hon’ble Gauhati High Court. In compliance with the various orders passed by the High Court as well as by the State Government order dated 04-09-2018, the petitioners had already deposited an amount of Rs. 86,00,967/- in four installments along with the interest accrued thereon by making special arrangement and by taking a loan from near and dear ones with the hope of finalization of the execution of the deed of allotment and delivery of possession. The petitioner submitted a representation dated 07-09-2018 addressed to the Director for necessary issuance of the Government documents and the same is still pending for disposal.

[5] On account of inaction on the part of the respondents, the petitioner approached this Hon’ble High Court by way of writ petition being WP(C) No. 950 of 2019 which was disposed of on 20-11-2019 directing the respondents therein to consider the representation dated 07-09-2019. Thereafter, the Director (Settlement & Land Records), Government of Manipur and the petitioner executed the deed of allotment on 13-02-2019 and thereafter, Jamabandi was issued in favour of the petitioner. [6] Although in the allotment order dated 30-12-2020, nothing was mentioned about the delivery of possession, in the order that was issued on 04-07-2018, the delivery of possession was mentioned.

In order to remove this contradiction, the petitioner submitted a representation dated 29-09-2020 addressed to the Director (Settlement & Land Records), Government of Manipur with a copy endorsed to the Secretary/ Commissioner (Revenue), Government of Manipur and the Deputy Commissioner, Imphal West, Government of Manipur requesting them to do the needful. Being aggrieved by the inaction on the part of the respondents, the instant writ petition has been filed by the petitioner. [7] When the matter is taken up for consideration, it has been submitted by Shri I.

Denning, learned counsel appearing for the petitioner that the instant writ petition can be disposed of by issuing an innocuous order and accordingly, the instant writ petition stands disposed of with the direction that the respondents shall consider the representation dated 29- 09-2020 submitted by the petitioner within a period of one month from the date of receipt of a copy of this order and disposed of the same by issuing a speaking order in respect thereof. [8] Copies of this order shall be sent to the counsel appearing for the parties through their WhatsApp/e-mail.
