JUSTICE ARINDAM LODH O_r_d_e_r 17. 01. 2020 Heard Mr. Raju Datta, learned counsel appearing for the accused-petitioner as well as Mr. Ratan Datta, learned PP appearing for the State-respondent. This is an application filed under section 438 Cr. P. C. for granting pre-arrest bail to the accused-petitioner, namely, Md. Dudh Miah, who is wanted in connection with R. K. Pur police station case No. 2019 RKP 133 under Sections 279/304(ii) of IPC and under Sections 177/184 and 187 of the Motor Vehicles Act, 1988. The allegation is that out of negligence an accident occurred and one person died. The investigation so far does not reveal that the accused person while driving his motor vehicle was in intoxicated condition. As such, this Court is inclined to release the accused-petitioner, namely, Md. Dudh Miah on pre-arrest bail.
Accordingly, it is ordered that in the event of arrest, the accused-petitioner, namely, Md. Dudh Miah, shall be released on pre-arrest bail, on furnishing a bail bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the Arresting Authority. However, the accused-petitioner shall appear before the investigating officer thrice in a week & shall co-operate and assist the process of investigation in all respects, also shall appear before the concerned police station as per direction of the investigating officer.
