IN THE HIGH COURT OF ORISSA AT CUTTACK CONTC No. 5588 of 2025 Rasmita Behera …. Petitioner Mr. M. R. Pradhan, Advocate -versus- Prahlad Narayan Sharma, IAS …. Opp. Parties Mr. S. K. Jee, AGA CORAM: JUSTICE DIXIT KRISHNA SHRIPAD ORDER 19. 12. 2025 CONTC Nos. 5588 & 5380 of 2025 & W. P. (C) Nos. 6011, Order No. 26812 & 31199 of 2025 02 Matters were argued by learned advocates for the parties very vociferously other day and this day. However, having argued, learned advocates appearing for the parties graciously agree with the suggestion of this Court that the petitioner in W. P. (C) No. 31199 of 2025 should be given posting in a nearby college, inasmuch as he has to peacefully retire from the service within about five months or so. With this proposal, learned AGA Mr. Jee is very graciously agreeable and assures the Court that said petitioner shall be given posting in the nearby college within two weeks. He also agrees that till then, the petitioner in W. P. (C) No.

31199 of 2025 shall be permitted to work in the same college without any interference from anybody subject to following usual discipline. In the above circumstances, all these cases are disposed off. It is open for the petitioner in W. P. (C) No. 31199 of 2025 to give the names of nearby colleges so that it becomes easy for the decision maker. The order dated 23. 10. 2024 as at Annexure-6 to W. P. (C) No. 31199 of 2025 now pales into insignificance. It is made clear that if there is any issue between the petitioner in W. P. (C) No. 31199 of 2025 and petitioner in W. P. (C) No. 26812 of 2025, appropriate relief can be availed by moving appropriate proceedings before the appropriate authority. In that connection, all contentions of the parties are kept open.
