Jhalajit, learned counsel, appears on behalf of the applicant; and Mr. Athouba Khaidem, learned PP, appears on behalf of the respondents. The present condone delay application has been instituted on behalf of Mayanglambam Khellendro Singh @ Amujao Singh, who is currently undergoing a life sentence pursuant to his conviction in Sessions Trial Case No. 14 of 2014 for the offences under Section 302 IPC. Mr. Athouba Khaidem, the learned PP, opposed the present application stating that the period of delay is long.
Be that as it may, it is an admitted position that the applicant/appellant is undergoing a life sentence and currently in custody. Needless to state that the accompanying appeal is a statutory appeal and that the same has been instituted on behalf of the lifer. In that MC (Crl. A. ) No. 10 of 2024 Page 1 view of the matter, in the interest of justice, the delay of 1595 days in filing the accompanying appeal is condoned. The present miscellaneous application is accordingly allowed and disposed of. Registry is directed to number the appeal, if it is otherwise found to be in order, and list the same for admission.
