JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Rajeeva Sharma, Sr. Advocate Mr. Om Prakash, Advocate For the State : Ms. Vandana Bharti, A. P. P. ----- Order No. 03 Date: 05. 12. 2024 1. The petitioners apprehending their arrest in connection with Pakur (Town) P. S. Case No. 231 of 2024 registered under Sections 115(2)/ 127(1)/ 117(2)/ 109/ 308(4)/ 308(5)/ 303(2)/ 3(5) of the Bharatiya Nyaya Sanhita, 2023, have prayed for grant of anticipatory bail. 2.

Learned senior counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F. I. R. th It has been alleged that on 19 September, 2024 the petitioners along with others stopped the vehicle of the informant near Anand Restaurant, Main Road, Pakur and forced him to join AJSU party at gunpoint. Thereafter, when the informant protested against the same, they assaulted him by means of iron rod on his forehead and snatched his gold chain. 3. It is further submitted that in fact, the petitioners have been roped in the present case by the informant due to political rivalry. Otherwise also, the injury sustained by the informant has been found simple in nature. The petitioners have no criminal antecedent as has been stated in paragraph no. 17 of the present anticipatory bail application. They, however, undertake to co-operate in the ongoing investigation.

Hence, they may be given the privilege of anticipatory bail. 4. Learned A. P. P. opposes the petitioners’ prayer for grant of anticipatory bail. 5. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioners on anticipatory bail. 6. Accordingly, the petitioners, above named, in the event of their arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Pakur in connection with Pakur (Town) P.
