Sr. No. 21 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CRTA No. 6/2019 c/w CRTA No. 5/2019 State Th. SP Pulwama & Ors. …Petitioner(s)/Appellant(s) Through: Mr. Syed Musaib, Dy. AG Vs. Tariq Ahmad Pandith ... Respondent(s) Through: None CORAM: HON’BLE MR. JUSTICE VINOD CHATTERJI KOUL, JUDGE O R D E R 31. 12. 2024 These transfer applications have been filed for transfer of the cases which are pending before the court of learned Sessions Judge, Pulwama. The trial in both the cases is going on and witnesses have been recorded. These petitions were filed way back in the year 2019. With the passage of time, it appears that the grounds on which the transfer was sought do not exist and as the petitioners are producing the evidence before the trial court and the witnesses have been examined, therefore, at this stage, it would not be in the interest of justice to transfer the trial. Mr. Syed Musaib, Dy.

AG, however, submits that the trial court may be asked to speed up the trial in these cases as these cases are pending since long. In view of the submissions made and in view of the fact that these petitions are pending since 2019 and the proceedings have not been stayed, trial is going on in both the case before the trial court, therefore, no purpose would be served to order transfer of these cases. Therefore these transfer applications are disposed of by directing the trial court to conduct the trial expeditiously and decide the same within a reasonable time. The petitioner shall be responsible for production of the remaining witnesses before the trial court Both the transfer applications are disposed of.
