Das, learned counsel appearing for the applicants. Also heard Mr. Raju Datta, learned PP appearing for the respondent-State. This is an application filed under Section 482 of BNSS, 2023 for granting anticipatory bail to the applicants in connection with Dharmanagar PS case No. 2024 DMN 093 registered under Sections 127, 117, 324, 109, 304, 3(5) of the BNS, 2023. Mr. Majumder, learned senior counsel for the applicants has submitted that the applicants are innocent and will not evade the process of trial if they are enlarged on anticipatory bail.
It is further submitted that the applicants are the permanent residents within the jurisdiction of this court. Mr. Datta, learned PP has produced the case diary and submitted that the injuries sustained by the victims are simple in nature. Considered the submission of learned counsel appearing for the parties. In view of the above submission, I am inclined to grant anticipatory bail to the accused-applicants. Accordingly, it is directed that in the event of arrest, the applicants, namely, Rajdeep Dhar, Suraj Dey and Sri Akash Roy @ Vicky Roy, shall be released on bail on executing a bond of Rs. 50,000/-each with one surety each of the like amount to the satisfaction of the arresting authority. With the above observation and directions, the instant application stands disposed of. Return back the case diary.
