IN THE HIGH COURT OF MANIPUR AT IMPHAL W. P. (C) No. 399 of 2020 Ningthoujam Rabikumar Singh …Petitioner -Versus- State of Manipur & 3 ors. ... Respondents B E F O R E HON’BLE MR. JUSTICE KH. NOBIN SINGH 20. 07. 2020 Heard Mr. N. Biren, learned counsel appearing for the petitioner. According to the petitioner, he is the pattadar of the Homestead land under patta No. 612(old), 669/1785(new) measuring an area of 0. 1174 Hectre/0. 2901 acre covered by C. S. Dag No. 242/770, Village No. 128 of Heirok Part – 1 and Agricultural land under patta No. 709 (new) measuring an area of 0. 5711 Hectre/1. 4112 Acre covered by D. S. Dag No. 2400, Village No. 128 of Heirok Part-1. After the death of his father his youngest brother namely, N. Ashabri Singh has wrongly & secretly entered/recorded his name in collusion with some unknown staffs of the Revenue Department of SDC Heirok into the jamabandi/Patta of the said Homestead land.
The petitioner came to know the recording of his youngest brother’s name in the said two patta/Jamabandi and accordingly, he approached the SDO, Thoubal, Govt. of Manipur by way of an application being R. R. No. 588/SDO/TBL dt. 02. 05. 2019 and pursuant to that, the SDO, Thoubal wrote a letter dated 07. 05. 2019 to the Sub-Deputy Collector, Heirok to look into the matter and submit a report. Thereafter, the SDC, Heirok wrote a letter dated 06. 06. 2019 to the SDO, Thoubal stating that all the land records standing in the name of Shri Ningthoujam Ashabari Singh will have to be treated as null and void as the same are fake documents being prepared in collusion with some unknown persons without following the due procedures of law. The grievance of the petitioner is that inspite the said letter dated 06. 06.
2019 being sent to the SDO by the SDC, Heirok, the SDO failed to take any appropriate action in the matter and being aggrieved by his inaction, the petitioner submitted an application dated16. 03,. 2020 to the Commissioner/Secretary (Revenue), Govt. Of Manipur; The Deputy Commissioner, Thoubal, Govt. Of Manipur and the SDO, Thoubal, Govt. of Manipur praying for cancellation/correction in respect of the name of Shri Ningthoujam Ashabari Singh. The further grievance of the petitioner is that despite the said application dated 16. 03. 2020 being submitted to them, they have not taken any action thereon and hence the instant writ petition has been filed by the petitioner. When the matter is taken up for consideration today, the learned counsel for the petitioner submits that the instant writ petition can be disposed of by issuing an innocuous order.
Accordingly, the writ petition stands disposed of with a direction that the respondents and in particular the SDO, Thoubal shall consider the application dated 16. 03. 2020 and dispose of the same within a period of one month from the date of receipt of a copy of this order by issuing a speaking order in respect thereof. Copies of this order shall be sent to the counsels appearing for the parties through their WhatsApp/e-mail.
