Court No. - 71 Case :- WRIT - C No. - 22874 of 2020 Petitioner :- Lallu Singh Respondent :- State of U. P. and Another Counsel for Petitioner :- Krishna Kumar Patel Counsel for Respondent :- C. S. C. ,Shri Prakash Mishra Hon'ble Mahesh Chandra Tripathi,J. Heard Shri Krishna Kumar Patel, learned counsel for the petitioner; Shri Sharad Srivastava, learned Standing Counsel for the State respondents and Shri Prakash Mishra, learned counsel for the caveator. By means of present writ petition the petitioner has challenged the impugned order dated 01. 10. 2020 passed by the second respondent, Sub Divisional Magistrate, Thakurdwara, District Moradabad, by which he has cancelled the fair price shop licence of the petitioner. Learned counsel for the petitioner submits that the present writ petition has been preferred against the impugned cancellation order dated 01. 10. 2020 and it has come up for admission hearing after two months.
Meanwhile, the petitioner has also preferred the statutory appeal alongwith the stay application, which is pending consideration. The request has been made for issuing direction to the Appellate Authority to decide the stay application within some stipulated time. Learned counsel for the respondents has no objection to the said prayer. No useful purpose would be served in keeping the writ petition pending. In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Appellate Authority to decide the stay application within two months from the date of receipt of a copy of this order. The appeal in question may be also decided expeditiously.
