Heard learned counsel for the parties and perused the material available on record. The petitioners have been arrested in connection with FIR No. 213/2020 of Police Station Kherwada, District Udaipur for the offences punishable under Sections 147, 148, 149, 186, 307, 332, 353, 283, 427, 435, 436, 117, 188, 153A, 505, 387, 440, 269, 270, 120B of IPC & Section 3/25 of Arms Act & Section 3 Public Property Damage Act & 8B National Highway Act & 51 Disaster Management Act. They have preferred these bail applications under Section 439 Cr. P. C. Learned Public Prosecutor has opposed the bail applications. Having regard to the totality of the facts and circumstances of the case but without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused-petitioners under Section 439 Cr. P. C. Accordingly, these bail applications filed under Section 439 Cr. P. C.
are allowed and it is directed that petitioners (1) Hitesh S/o Devilal (2) Rahul S/o Kishanlal (3) Praveen S/o Sh. Vaktaram (4) Dinesh S/o Devi Lal (5) Anil S/o Devi Lal (6) Linkesh S/o Mansukh Lal (7) Mukesh S/o Nathu Ji (8) Rohit (4 of 4) [CRLMB-13948/2020] @ Bunty S/o Ramesh Chand Damor (9) Bhawani Shankar S/o Kantilal and (10) Jagdish S/o Kalu shall be released on bail in connection with FIR No. 213/2020 of Police Station Kherwada, District Udaipur provided each of them execute a personal bond in a sum of Rs. 50,000/- with two sound and solvent sureties of Rs. 25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
