Case No. 141 of 2019 corresponding to S. T. Case No. 123 of 2022 for the alleged commission of the offences punishable under Sections 341/ 342/ 367/ 368/294/323/328/506/379/34 of the IPC, pending in the Court of the learned Additional District Judge, Athagarh, by which the N. B. W. has been issued against him. 2. Learned counsel for the petitioner submits that the petitioner was admitted to bail on 18. 11. 2019, however, he could not appear before the learned Court below leading to the issuance of the N. B. W. against him on 16. 05. 2024. 3.
Learned counsel for the petitioner on instruction, submits that, the petitioner would surrender/appear before the learned Court below on or before 10. 01. 2025 and seek remedy available to him under law. 4. On the basis of the aforementioned facts and submissions made at the Bar, the order dated 16. 05. 2024 passed in connection with Khuntuni P. S. Case No. 141 of 2019 corresponding to S. T. Case No. 123 of 2022, pending in the Court of the learned Additional District Judge, Athagarh is set aside, subject to the petitioner surrendering before the Court below on or before 10. 01. 2025 and depositing cost of Rs. 500/- (Rupees five hundred) with the High Court of Orissa Advocates’ Welfare Fund.
