Seityandra, learned counsel appearing for the petitioner.
By the instant writ petition, the petitioner has prayed for issuing a direction to the police, respondent Nos. 2 and 3 herein for making a proper enquiry and also to dispose of the application dated 23-08-2019. According to the petitioner, he is an innocent person living with his small family. On 10-04-2013 at about 10:30 p. m. , when the petitioner and his wife went to watch a “Thabal Chongba”, the respondent Nos. 4 and 5 being drunk, pressurized the petitioner to drink liquor. When the petitioner refused to do it, the respondent No. 4 poured the liquor from the Cril. Petn. No. 25 of 2020 Contd…. /-bottle to the apparel of the petitioner. The petitioner scolded and asked the respondent No. 4 to be decent to which, the respondent No. 5 taunted and ridiculed the petitioner by using filthy language. At that point of time, the respondent No. 5 roughly bruised on the face of the petitioner and slapped hard on the left ear of the petitioner.
The petitioner lost consciousness and when he regained consciousness, the respondent No. 4 rushed towards the petitioner and kicked and gave several blows on his stomach. The petitioner was taken to the District Hospital, Thoubal for medical treatment and thereafter, he was taken to the Shija Hospital for further treatment. During the course of the treatment, it was confirmed that the left ear of the petitioner was ruptured and his hearing impaired. Thereafter, the petitioner reported to the Councilor of Ward No. 8 of the Thoubal Municipal Council for bringing a settlement but the respondent Nos. 4 and 5 refused to the proposal made by the Councilor. Having no alternative, the petitioner approached the O. C. , Thoubal Police Station for conducting investigation and thereafter, the petitioner approached the CJM, Thoubal, by way of a complaint application, who was pleased to pass an order dated 17-07- 2013 directing the O. C.
, Thoubal Police Station for investigation of the case and submit a report thereafter. It is the case of the petitioner that the police failed to submit a report. Since the petitioner was undergoing treatment, he could not approach the appropriate forum for redresseal of his grievance. Since the petitioner had already approached the CJM, Thoubal with a complaint on the basis of which the CJM, Thoubal had already passed an order dated 17-07-2013. The only grievance of the petitioner is that despite the said order being passed by the CJM, Thoubal, the police failed to submit a report. In view of the above, the writ petition stands disposed of with a direction that the petitioner may approach the CJM, Thoubal again for redressal of his grievance and in case he is still aggrieved with the order Cril. Petn. No. 25 of 2020 Contd…. /-passed by the CJM, it is open to him to approach the appropriate forum for redresssal of his grievance.
