Nobody appears on behalf of the petitioner even on repeated calls. 3. Order dated 04. 12. 2020 reads as follows:- “Nobody appeared on behalf of the petitioner even on repeated calls. Mr. Arpan Mishra, learned counsel for the respondent-BCCL is present. With a view to give one more opportunity to the petitioner, put up this case on 18. 12. 2020 under the heading ‘For Final Disposal’. ” 4. In spite of aforesaid order the petitioner is not represented by his counsel, however Mr. Arpan Mishra is present on behalf of the respondent-BCCL. 5. From records it appears that on 11. 12.
2019 when the case was posted for hearing, learned counsel for the petitioner sought adjournment for filing rejoinder, however the same has not been filed till date, which shows that the petitioner has lost his interest in this case after filing of the counter affidavit. -02- 6. Mr. Arpan Mishra, learned counsel for the respondent-BCCL submits that the petitioner has raised the issue regarding date of birth at the fag end of his employment as such the writ application may be dismissed. 7. In view of the aforesaid facts and circumstances of the case and looking to the prayer of the petitioner without going into merit of the case, the instant writ application is dismissed for non-prosecution.
