State of Manipur & anr. … Respondents B E F O R E HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH O R D E R 17-12-2024 Heard Mr. Syed Murtaza Ahmad, learned counsel appearing for the petitioner and Mrs. L. Monomala, learned GA appearing for the respondents. In view of the limited prayer made by the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself.

At the outset, the learned counsel appearing for the petitioner submitted that on expiry of the term of the Governing Body of the Royal Academy of Law, Oinam, the petitioner submitted a representation dated 11-12-2024 to the Commissioner, Education Department, Government of Manipur, with a request for allowing them to continue as a Caretaker Governing Body of the Royal Academy of Law, Oinam, till the new Governing Body is constituted in terms of the relevant provisions of law. The learned counsel further submitted that under Section 27A of the Manipur Education Code, 1982, there is provision for constituting a Caretaker Governing Body by the Government and as such, the Commissioner, Education Department, Government of Manipur, is the competent authority to consider and decide the WP(C) No. 851 of 2024 Contd…/- -2- said representation.

The learned counsel, accordingly, prays for disposing of the present writ petition by issuing a simple direction to the Commissioner, Education Department, Government of Manipur, to consider the said representation and dispose of the same by issuing a speaking order within a stipulated period. Mrs. L. Monomala, learned GA appearing for the respondents fairly submitted that as the prayer of the petitioner is confined to the consideration and disposal of the representation submitted by him, she has no objection in disposing of the present writ petition as prayed for by the counsel appearing for the petitioner.

Taking into consideration the submissions advanced by the learned counsel appearing for the parties and on perusal of the record, this court is of the considered view that interests of justice will be served by issuing the following directions:- (i) The Commissioner, Education Department, Government of Manipur, is hereby directed to consider the representation dated 11-12-2024 submitted by the petitioner on its own merit and strictly in terms of the applicable provisions of law and to dispose of the same by issuing a speaking order; and (ii) The whole process shall be completed within a period of one month from the date of receipt of a certified copy of this order. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda WP(C) No. 851 of 2024 Contd…/- WP(C) No. 851 of 2024 Contd…/-
