GOLIAHATI, P. S. AND DIST-BARPETA, ASSAM VERSUS THE STATE OF ASSAM REPRESENTED BY THE PUBLIC PROSECUTOR, ASSAM Advocate for the Petitioner : MR. S MUNIR Advocate for the Respondent : PP, ASSAM BEFORE HONOURABLE MR. JUSTICE AJIT BORTHAKUR ORDER 11. 12. 2020 Heard Mr. S. Munir, learned counsel for the accused-petitioner and Mr. N. K. Kalita, learned Addl. PP for the State/respondent. By this application under Section 439 Cr. P. C. , the accused-petitioner, namely, Dhanjit Das @ Dhan has sought for bail in connection with Barpeta Police Station Case No. 1498/2020, under Sections 302/324 of the IPC. # 2/2 The FIR shows that one Chinmoy Das of Ghoramara collected blood from the people of the locality by way of illegal means by giving them Rs. 500/- or Rs. 1000/- taking advantage of their poverty. Due to such donation of blood, one person from the locality also died about one week back of filing the FIR. Having considered the submissions made by learned counsel of both sides and the contention made in the petition including the F. I. R. , this Court finds that further detention of the accused-petitioner may not be required in the interest of ongoing investigation into the case. Therefore, it is provided that the accused-petitioner, named above, shall be released on bail of Rs. 25,000/- (Rupees Twenty Five Thousand) only, with one surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Barpeta, subject, of course, to the following conditions: 1. That the accused-petitioner shall co-operate in the investigation as and when required; and 2.

That the accused-petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer. This disposes off the bail application. JUDGE Comparing Assistant
