Prusty, Advocate -versus- State of Odisha & Ors. ..... Opposite Parties Mr. A. Tripathy, AGA Mr. D. N. Rath, Advocate (Opp. Party Nos. 4, 7, 8 & 9) Mr. S. B. Jena, Advocate (Opp. Party Nos. 6, 10, 13 to 15) Mr. G. Mishra, Sr. Advocate (Intervener) Mr. A. Das, Advocate (Intervenors) Mr. S. Routray, Advocate (Intervenors) CORAM: THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY ORDER 08. 04. 2026 Order No. 04 1. This matter is taken up through hybrid mode. 2. Heard learned counsel appearing for the Parties. 3. Learned Sr. Counsel appearing for the Petitioners contended that even though the present writ petition has been filed challenging the provisional gradation list so published on 19. 11.
2024 under Annexure-14, but without considering the objection so filed by the Petitioner to the said provisional gradation list, the authorities when extended the benefit of promotion, the present writ petition was filed. 3. 1. It is also fairly contended that during pendency of the writ petition, basing on the position maintained in the provisional Page 1 of 2. gradation list, promotion has been extended in favour of some persons. 4. However, it is fairly contended that Petitioners will have no grievance, if the objection so filed to the provisional gradation list will be considered and final gradation list will be published thereafter. 5. Learned Addl. Govt. Advocate and learned counsels appearing for the Private Opp. Parties as well as learned counsels appearing for the Intervenors have no serious objection to the course of action proposed by the learned Sr. Counsel appearing for the Petitioners. 6.
Having heard learned counsel appearing for the Parties and considering the submission made, since it is not disputed that final gradation list has not yet been published, this Court while disposing the writ petition, directs Opp. Party No. 1 to consider the objection so filed by the Petitioner under Annexure-15 series and publish the final gradation list with due consideration of the objection within a period of six (6) weeks from the date of receipt of this order. 7. The writ petition as well as all the pending I. As. accordingly stand disposed of. Interim order passed on 28. 01. 2025 stands vacated. (BIRAJA PRASANNA SATAPATHY) Judge Sneha Page 2 of 2.
