Counsel for Applicant :- Paritosh Sukla Counsel for Opposite Party :- G. A. Hon'ble Rohit Ranjan Agarwal,J. Heard learned counsel for the applicant and learned AGA for the State. By means of this application, the applicant, who is involved in Case Crime No. 160 of 2020 under Sections 2/3 of U. P. Gangster & Antisocial Activities (Prevention), Act, 1986 Police Station Lodha District Aligarh is seeking enlargement on bail during the trial. Learned counsel for the applicant has contended that in the gang chart three cases have been shown against the applicant and in paragraph 10 of the affidavit to the bail application two other cases have been disclosed other than the gang-chart. Learned counsel further submits that in all the cases applicant has already been granted bail, copy of the bail orders have been brought on record as annexure No. 3 to the affidavit.

Applicant is languishing in jail since 08. 09. 2020. Learned A. G. A. vehemently opposed the prayer of bail. However, he does not dispute the fact that applicant has been granted bail in the cases mentioned in the gang-chart. Considering the facts and circumstances of the case, keeping in view the nature of the offence, evidence, complicity of the accused, and the dictum of Apex Court in the case of Dataram Singh Vs.
