IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 4113 of 2020 ------- 1. Navlesh Kumar Singh 2. Deoashish Singh 3. Kamal Kishore Yadav … … Petitioners Versus The State of Jharkhand … … Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY Through- Video Conferencing ------- For the Petitioners : Mr. Manoj Kr. No. 2, Advocate For the State : Mrs. Anuradha Sahay, A. P. P. ------- 02/15. 12. 2020 Heard Mr. Manoj Kr. No. 2, learned counsel for the petitioners and Mrs. Anuradha Sahay, learned A. P. P. for the State. Defect no. 9(i) as pointed out by the office is ignored. The petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Kharaundhi P. S. Case No. 23/2020. It has been submitted by Mr. Manoj Kr. No. 2, learned counsel for the petitioners that the petitioner no. 1 has already been arrested and therefore this application has become infructuous so far as the petitioner no. 1 is concerned.

In view of the said submission, this application stands dismissed as infructuous as against petitioner no. 1. So far as the petitioner nos. 2 and 3 are concerned they appear to be the owner cum driver as well as the driver of their respective vehicles. The allegations reveal that two tractors illegally loaded with sand were seized. In view of the fact that the petitioners had fled away by leaving their respective vehicles and were involved in transportation of sand in an illegal manner, I am not inclined to extend the privilege of anticipatory bail to the petitioner nos. 2 and 3. This application accordingly stands disposed off. (R. Mukhopadhyay, J. ) Alok/-
