This Court perused the material available on record. Heard learned counsel for the petitioner on video call and learned P. P. The petitioners have been arrested in connection with FIR No. 102/2020 of Police Station Phalodi, District Jodhpur for the offences punishable under Sections 147, 148, 323, 354, 452 and (2 of 2) [CRLMB-5257/2020] 307/149 IPC. They have preferred this bail application under Section 439 Cr. P. C. Learned counsel for the petitioners submits that co-accused Ramswaroop has been granted bail by this Court vide order dated 19. 5. 2020 (S. B. Crl. Misc. Bail Application No. 4874/2020). Learned Public Prosecutor opposed the bail application.
Having regard to the totality of the facts and circumstances of the case and the fact that co-accused Ramswaroop has been released on bail by this Court as also the fact that conclusion of the proceedings is likely to take some time and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused petitioners under Section 439 Cr. P. C. Accordingly, this bail application filed under Section 439 Cr. P. C. is allowed and it is directed that petitioners (1) Rajuram S/o Khamuram, (2) Shrawan Kumar S/o Khamuram and (3) Bagaram S/o Tejaram shall be released on bail in connection with FIR No. 102/2020 of Police Station Phalodi, District Jodhpur provided each of them executes a personal bond in a sum of Rs. 50,000/- with two sound and solvent sureties of Rs.
25,000/-each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial. (DR. PUSHPENDRA SINGH BHATI),J 54-Sphophaliya
