C. , the accused-petitioner, namely, Md. Saheb Ali @ Saheb Ali has sought for bail in connection with Chhaygaon Police Station Case No. 1095/2020, registered under Sections 20/29 of NDPS Act (Corresponding to GR No. 1719(k)/2020). Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, appearing for the State. Also perused the materials on record.
An amount of 650 grams of ganja was recovered from the possession of the accused petitioner and it was seized. The amount seized is below the comercial quantity. Considering all entirety of the matter and the length of detention since (06. 11. 2020) it appears that further custodial detention of the accused person is not warranted. Accordingly, the petitioner is hereby allowed to go on bail of Rs. 20,000/- with one suitable surety of the like amount, to the satisfaction of the Special Page No. # 2/2 Judge, Amingaon(K).
