The petitioner has been made accused in connection with Special POCSO Case No. 31 of 2024, arising out of Sadar (Bara Bazar O. P. ) P. S. Case No. 127 of 2024, for the offences registered under Section 377 of the Indian Penal Code and Section 6 of the POCSO Act, pending in the court of Sri Vishal Kumar, learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag. Petitioner and co-accused are alleged to have sodomized the son of the informant.
Attention has been drawn towards the statement of the victim and informant recorded during trial in which both have not supported the prosecution case and they have been declared hostile. It was submitted that similarly situated co-accused Md. Arbaz @ Md. Arbaj has been granted bail by this Court vide B. A. No. 8054 of 2024. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Vishal Kumar, learned Additional Sessions Judge-III-cum-Special Judge, POCSO Act, Hazaribag or his successor, in connection with Special POCSO Case No. 31 of 2024, arising out of Sadar (Bara Bazar O.
