Serial No. 24 Suppl. List HIGH COURT OF MEGHALAYA AT SHILLONG WP (C) No. 326 of 2020 Date of Order: 16. 12. 2020 University of Science & Technology, Vs. State of Meghalaya & 2 Ors. Meghalaya. Coram: Hon’ble Mr. Justice Ranjit More, Judge Appearance: For the Petitioner/Appellant(s) : Mr. S. P. Mahanta, Sr. Adv. with For the Respondent(s) : Mr. A. Kumar, AG. With Mr. S. Sengupta, Addl. Sr. GA. Mr. A. Kumar, learned AG at the outset having taken instruction from the all concerned makes a statement that petitioner is entitled to recover hostel fees from the students who are occupying the hostel premises. Statement accepted. Learned AG also placed on record the order dated 16-10-2020 by the Principal Secretary to the Govt. of Meghalaya, Education Department. By this order, earlier order dated 26-06-2020 is modified.

It is made clear that the students who do not vacate the hostel post 16-06-2020 and their belongings still lying in the hostels should pay hostel fees as the exemption of hostel fees is applicable to the students who are not using the hostel facilities, even though they may have contracted for annual accommodation. Order dated 16-10- 2020 is taken on the record. Mr. S. P. Mahanta, learned Senior counsel for the petitioner in the light of the statement referred above made by the Advocate General and the order dated 16-10-2020, fairly concedes that petitioner’s grievance made in the writ petition stands redressed, at this stage. Petition accordingly disposed of. Judge Meghalaya 16. 12. 2020 “Biswarup, PS”
