[2025:RJ-JD:1120] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 302/2025 Harlal @ Harkha Ram S/o Sri Moola Ram, Aged About 27 Years, R/o Samdaro Ka Tala, Sindhari P. s. Dist Balotra (Lodged In Dist Jail , Balotra ) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Vijay Raj Bishnoi For Respondent(s) : Mr. Narendra Gehlot, PP with Mr. Omprakash Choudhary HON'BLE MR. JUSTICE MANOJ KUMAR GARG Order 08/01/2025 The petitioner has been arrested in connection with FIR No. 116/2023 of Police Station Sindhari, District Barmer, for the offence punishable under Sections 147, 148, 458, 323, 427, 354 & 395 of IPC. He has preferred this second bail application under Section 483 BNSS. The first bail application was dismissed as not pressed vide order dated 26. 11. 2024 with liberty to file afresh after filing of the challan.

Learned counsel for the petitioner submits that now the challan has been filed and similarly situated co-accused Ramaram @ Ramesh Kumar has already been enlarged on bail and the case of present petitioner is not distinguishable from that of co-accused. The accused-petitioner has been in judicial custody since 23. 09. 2024 and the trial of the case will take sufficient long time [2025:RJ-JD:1120] (2 of 2) [CRLMB-302/2025] to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioner. Learned Public Prosecutor has opposed the bail application. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 483 BNSS. Accordingly, the second bail application filed under Sec.

483 BNSS is allowed and it is directed that petitioner Harlal @ Harkha Ram S/o Sri Moola Ram, shall be released on bail in connection with FIR No. 116/2023 of Police Station Sindhari, District Barmer, provided he executes personal bond in a sum of Rs. 1,00,000/-with two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
