Learned counsel appearing for the petitioner through video conferencing stated that the benefit of bail has already been granted to the co-accused persons, namely, Anil Barupal, Sunil, Tikuram, Rajesh Kumar Bhambu, Jagdish @ Jaggu & Sunil, Sachin (2 of 3) [CRLMB-14905/2020] Gila and Ranjeet Moondh; that the case of the present accused-petitioner is on the same footing as of the co-accused; and that the trial will take time, therefore, benefit of bail may be granted to the present accused-petitioner. Per contra, learned Public Prosecutor opposed the bail application of the accused-petitioner. Heard and considered the arguments advanced by the learned counsel appearing for the petitioner through video conferencing and learned Public Prosecutor, present-in-person. Having regard to the facts and circumstances of the case, particularly to the facts that the benefit of bail has already been granted by the coordinate Bench/s of this Court to the co-accused persons, namely, Anil Barupal S/o Manaram, vide order dated 24. 11. 2020 (Bail Application No. 13235/2020), Sunil S/o Bhiyaram @ Bhiluram, vide order dated 23. 09. 2020 (Bail Application No. 10124/2020) and so many other persons, as mentioned hereinabove; that the case of the present accused-petitioner is not different from the other co-accused persons; and that further trial will take sufficiently long time, therefore, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.
