[2026:RJ-JP:37979] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 10461/2026 CNR: RJHC010793432026 | URN: CRLMB / 22849U / 2026 Shantilal S/o Shri Mohanlal, Aged About 44 Years, Resident Of Mithdi, Police Station Nosra, District Jalore Rajasthan. Presently Lodged In District Jail, Jalore ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ashok Upadhyay for Mr. Mool Singh Panwar For Respondent(s) : Mr. Surendra Bishnoi, PP Mr. Firoz Khan HON'BLE MR. JUSTICE SANDEEP SHAH Order 10/08/2026 1. The applicant has filed the present bail application under Section 483 of BNSS being aggrieved against the order dated 29. 07. 2026 passed by the learned Sessions Judge, Jalore in Criminal Miscellaneous Bail Application No. 375/2026, whereby the bail application filed by him under Section 483 of B. N. S. S. was rejected. The accused-applicant is behind the bars, pursuant to the F. I. R. No.
81/2026 registered at Police Station Bishangarh, District Jalore for the offences punishable under Sections 308(3), 318(4) and 61(2) of BNS, 2023. 2. Learned counsel for the applicant submits that offences alleged are triable by the Court of Magistrate. He further submits that, as far as the role assigned to the applicant is concerned, he [2026:RJ-JP:37979] (2 of 3) [CRLMB-10461/2026] got the brother of the complainant - Yogesh married to Seema, and thereafter, Seema ran away and refused to continue the matrimonial relationship. He further submits that the applicant has been behind bars since 24. 07. 2026 and that no recovery is to be effected from the applicant. He further submits that the trial of the case will take sufficiently long timeto conclude. He, therefore, implores this Court to allow the present Criminal Miscellaneous Bail Application. 3.
Per contra, learned Public Prosecutor as well as learned counsel for the complainant vehemently oppose the bail application and submit that considering the nature of offences, the applicant does not deserve to be enlarged on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the arguments advanced by both the sides and having regard to the facts and circumstances of the case, including the facts that the offences alleged are triable by the Court of Magistrate, the only allegation against the applicant is with regard to arranging the marriage between complainant's brother and Seema, the applicant is behind the bars since 24. 07. 2026, no recovery is to be effected from the applicant, and the trial of the case will take sufficiently long time to conclude, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the applicant on bail. 6.
Consequently, the bail application under Section 483 B. N. S. S. is allowed. It is ordered that the accused-applicant Shantilal S/o Shri Mohanlal arrested in connection with F. I. R. [2026:RJ-JP:37979] (3 of 3) [CRLMB-10461/2026] No. 81/2026 registered at Police Station Bishangarh, District Jalore shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 50,000/- and two sureties of Rs. 25,000/- each, to the satisfaction of learned trial Court, for his appearance before that Court on each & every date of hearing and whenever called upon to do so till completion of the trial. 7. It is further, made clear that the findings recorded/observations made hereinabove are for limited purposes of adjudication of bail application and the same shall not prejudice the trial of the case in any manner.
