Heard learned counsel for the parties. Learned counsel for the petitioner is aggrieved by the non-disposal of his application filed under section 28- A of the Land Acquisition Act, 1894 arising out of L. A. R. No. 09 of 2017 pending before the Special Land Acquisition Officer, Lower Indra Irrigation Project, Khariar, District-Nuapada (opp. party no. 3). In such background, he prays that a direction be issued to the opp. party no. 3 to dispose of the said application expeditiously.
Considering the submission made and without expressing any opinion on the merits of the case, this Court disposes of the writ petition directing the Opp. Party No. 3 to dispose of section 28-A application arising out of L. A. R. Case No. 09 of 2017 in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner. It is further directed that in case the application of the petitioner under section 28-A of the Land Acquisition Act, 1894 is allowed and if there is no other legal impediment, the compensation amount be disbursed in favour of the petitioner within a period of two months thereafter.
