JUSTICE BALJINDER SINGH SANDHU Order 05/08/2026 Heard learned counsel for the parties, and perused the material available on record.
The petitioners have been arrested in connection with FIR No. 167/2026 of Police Station Lohawat, District Phalodi for the offences punishable under Section 8/18 of NDPS Act. They have preferred these bail applications under Section 483 of BNSS. [2026:RJ-JP:36952] (2 of 3) [CRLMB-10239/2026] Learned counsel for the petitioners submits that the petitioners have been falsely implicated in these cases. He further submits that narcotic contraband i. e. Opium weighing 139 grams alleged to have been recovered in the matter is below commercial quantity. He further submits that there is no criminal antecedents of the petitioners. It is, thus, prays that the petitioners may be enlarged on bail. The petitioners are in custody from the date of their arrest. It is also submitted that conclusion of the trial of the case will take considerable amount of time. Per contra, learned Public Prosecutor has vehemently opposed the bail application.
This Court has considered the arguments raised by learned counsel for the petitioners. The narcotic contraband i. e. Opium weighing 139 grams alleged to have been recovered in the matter is below commercial quantity. There is no criminal antecedents of the petitioners. The petitioners are in custody from the date of their arrest. Hence, keeping in view of the fact that conclusion of the trial of the case is likely to take time; the narcotic contraband alleged to be recovered from the petitioners is below commercial quantity and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case they are enlarged on bail and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the petitioners under Section 483 of BNSS.
Accordingly, these bail applications filed under Section 483 of BNSS is allowed and it is directed that petitioner –Kanwarlal S/ o Dhanaram and Vikas S/o Jagdish shall be released on bail in [2026:RJ-JP:36952] (3 of 3) [CRLMB-10239/2026] connection with aforesaid FIR, if not wanted in any other case, provided each of them executes a personal bond in the sum of Rs. 1,00,000/- with two sound and solvent sureties of Rs. 50,000/-each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
