IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 14411 of 2025 Sk. Habiboor Raheman …. Petitioner @ Habibur Raheman Mr. A. Pattanaik, Advocate -versus- State of Odisha …. Opposite Party Mr. S. Panigrahi, ASC CORAM: JUSTICE V. NARASINGH ORDER 22. 12. 2025 Order No. 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G. R. Case No. 846 of 2017 pending on the file of learned J. M. F. C. -I (Cog. Taking), Bhadrak, arising out of Puruna Bazar P. S. Case No. 94 of 2017 for commission of offences punishable under Sections 147/ 148/ 294/ 427/ 436/ 395/ 454/ 153A/ 153A(1)/ 153A(2)/ 506/ 149 of IPC. 3. It is submitted by the learned counsel for the Petitioner that the co-accused have been released on bail in terms of the order dated 07. 10. 2024 & 28. 10. 2024 in ABLAPL Nos.

10997 of 2024 & 11725 of 2024 respectively and since the Petitioner is at all fours with the co-accused, he may be protected by pre-arrest bail. 4. Learned counsel for the State opposes the prayer for pre-arrest bail, inter alia, on the ground that the Petitioner has criminal antecedents and submits that charge sheet has been filed citing the Petitioner as an absconder. 5. It is clarified by the learned counsel for the Petitioner that antecedents relate to the self-same incident. Hence, that ought not to deter this Court from considering the prayer for anticipatory bail on its own merit. 6. Considering the rival submissions, release of the co-accused and the generality of the allegation, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper. 7.

Additionally, it is directed that Petitioner shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin for the next three months and thereafter, as directed by the learned Court in seisin. Certification of such appearance shall be submitted to the Court in seisin. 8. It is needless to state that the Petitioner shall cooperate with the ongoing investigation. 9. Accordingly, the ABLAPL stands disposed of. U. C. C. as per rules. Signature Not Verified Digitally Signed Signed by: AYESHA ROUT (V.
