JUSTICE RUMI KUMARI PHUKAN ORDER 21. 12. 2020 By this application under Section 439 CrPC, petitioner, namely, Kuddus Ali, who is arrested on 01. 12. 2020, has prayed for granting him regular bail, in connection with Laharighat PS Case No. 482/2020, registered under Sections 342/384/326/307/34 IPC. Heard the learned counsel for both the sides. Also perused the record and the Case Diary. Although a serious allegation has been raised by the informant that the accused persons named Page No. # 2/2 in the FIR, including the present petitioner, who has brought Rs.
1,10,000/- from his son by confining him in their house and also made some assault, but the statement of the victim himself is silent as about the snatching of money and gold etc. , save and except that he was kept in the house of the accused persons and he was assaulted and abused. The medical report is also not conclusive as regards any serious injury sustained by the accused. Considering all entirety of the matter, the petitioner is hereby allowed to go on bail of Rs. 20,000. 00, with one surety of the like amount, to the satisfaction of learned CJM, Morigaon.
