State of Manipur & ors. … Respondents B E F O R E HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH O R D E R 14-10-2024 Heard Mr. I. Lalitkumar, learned senior counsel assisted by Mr. N. Khelemba, learned counsel appearing for the petitioner; Mrs. L. Monomala, learned GA appearing for the respondents No. 1 and 2 and Ms. RK Tanya, learned counsel appearing for the respondent No. 3. The present writ petition has been filed assailing the Memorandum dated 12-08-2016 furnishing the Article of Charges to the petitioner for holding a Departmental Enquiry against him. Subsequent to the filing of the present writ petition, the authorities, after holding the Departmental Enquiry, imposed major penalty against the petitioner. Having been aggrieved by the imposition of the penalty, the petitioner filed a writ petition being WP(C) No.

807 of 2019 challenging the same. In my considered view, if the petitioner is successful in WP(C) No. 807 of 2019, the relief sought for by the petitioner for reinstatement in service can be granted by this court and that there is no need for considering the issue raised in the present writ petition. In view of the above factual position, this court is of the considered view that no cause survives for adjudication in the present writ petition and accordingly, the present writ petition is hereby closed as infructuous.
