HIGH COURT OF TRIPURA AGARTALA AB 58 of 2024 Rajesh Saha ... … Accused-Applicant(s) Versus The State of Tripura …. -Respondent(s) For the Applicant(s) : Mr. D. Datta, Advocate For the Respondent(s) : Mr. Raju Datta, PP HON’BLE MR. JUSTICE ARINDAM LODH Order 20/11/2024 Heard Mr. D. Datta, learned counsel appearing for the accused-applicant. Also heard Raju Datta, learned PP appearing for the State-respondent. This is a case where the accused-applicant has come up with an application for granting him pre-arrest bail. The accused-applicant has been implicated in a murder case. The wife of the deceased victim lodged the FIR. There were several injuries in the body of the deceased. Ultimately, he succumbed to injuries. Investigation is going on. Non-bailable arrest warrant also has been issued on 13. 11. 2024 on the prayer of the investigating officer. Mr.
Datta, learned counsel for the accused-applicant has submitted that though the wife of the victim was an eye witness to the incident, yet she has not named the accused persons in the FIR. For this reason, according to Mr. Datta, learned counsel, there is some cloud in implicating the accused-applicant in commission of the murder. I have considered the submission of learned counsel for the accused-applicant as well as Mr. Datta, learned P. P appearing for the State-respondent. Considering the matter in its entirety, I direct the accused-applicant, namely, Rajesh Saha to surrender before the court of learned Chief Judicial Magistrate, Udaipur, Gomati Tripura within 48 hours. After his surrender and on the prayer of bail application, if any, learned CJM will keep it in mind that the name of the accused person has not been mentioned in the FIR and thereafter, shall decide and dispose of the bail application, if any, on merits after perusal of the case diary.
With the aforesaid direction, the instant anticipatory bail application stands disposed. JUDGE Rohit Digitally signed by SANJAY SANJAYGHOSH Date: GHOSH 2024. 11. 20 17:04:42 +05'30'
