The State of Tripura and Ors. ………….. Respondent(s). For Petitioner(s) : Mr. P Roy Barman, Advocate, Mr. Kawsik Nath, Advocate. For Respondent(s) : Mr. Debalaya Bhattacharjee, Govt. Advocate. HON’BLE THE CHIEF JUSTICE MR. AKIL KURESHI _O_R_D_E_R_ 01. 02. 2020 Learned counsel for the parties jointly state that issues arising in these petitions are similar to those arising in WP(C) No. 1241/2019 and connected petitions in case of Dr. Pradip Debnath Vs. State of Tripura. Page - 2 of 3 th In the said group of petitions on 4 December, 2019 following order was passed : “Facts in all these petitions are common.

Petitioners are Assistant Professors in College run by Tripura Government. They seek the directions for being granted benefit of movement to the higher academic grade pay from ₹6000 to ₹7000 in pay band of ₹15,600-₹39,100 under CAS w. e. f. 21. 04. 2012 instead of 30. 09. 2012 which has been granted to them. Their further prayer is for being granted higher academic grade pay from ₹7000 to ₹8000 in the pay band of ₹15,600-₹39,100 under CAS-I w. e. f. 21. 04. 2017 instead of 30. 09. 2017. Their case is that they possess the higher educational qualification of doctorate and have also completed 4(four) years of service which according to them would entitle them the upward movement in the grade pay which the Government has not granted from the due dates. It is undisputed that all the petitioners have made representations to the Government in this respect. These representations are pending.

In facts of the present case, I am of the opinion that these issues should be at the first instance examined by the concerned authority. Under the circumstances, respondent No. 1, Principal Secretary, Directorate of Higher Education, Government of Tripura shall examine the grievances of the petitioners and in particular those raised in their respective representations and dispose of the representations within a period of 2(two) months from the date of receipt of the copy of this order by a speaking order. If the decision of the said authority is adverse to the petitioners, it would open for them to approach this Court by filing fresh petitions. With these directions, the petitions are disposed of. ” Page - 3 of 3 This order and directions contained therein shall cover these cases also, with the modification that the representations of the present petitioners shall be disposed of within a period of 2(two) months from the date of receipt of copy of this order by a speaking order.
