Item No. 50 IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 159 of 2025 Kh. Nawaz Khan & 2 ors. Petitioner/s Vs. State of Manipur & anr. Respondent/s BEFORE HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 17. 09. 2025 Heard Mrs. Th. Babita, learned counsel appearing for the petitioners; and Mrs. L. Monomala, learned G. A. appearing for the respondents. At the outset, the learned counsel appearing for the petitioners submitted that for redressing their grievances raised in this writ petition, the petitioners have already approached the authorities by filing the representations (3 in nos. ) all dated 27. 01. 2025 and that the said representations are still pending for consideration and disposal by the authorities.
The learned counsel appearing for the petitioners, submitted that the petitioners will be satisfied for the time being if the present writ petition is disposed of by directing the Director of Health Services, Government of Manipur, to consider the aforesaid representations on its own merit and strictly in terms of the applicable rules and to dispose of the same by issuing a speaking order within a stipulated period. Mrs. L. Monomala, learned G. A. appearing for the respondents, fairly submitted that as the prayer made on behalf of the petitioners are confined to the consideration and disposal of the representations submitted by them, she has no objection in disposing of this writ petition as prayed for by the learned counsel appearing for the petitioners.
Considering the submission made by the learned counsel appearing for the parties, this Court is of the considered view that it will be in the interest of justice to issue the following directions:- (i) The Director of Health Services, Government of Manipur, is hereby directed to consider the representations (3 in nos. ) all dated 27. 01. 2025 submitted by the petitioners on its own merit and strictly in terms of the applicable rules and to dispose of the same by issuing a speaking order. (ii) It is made clear that the whole process should be completed within a period of 3(three) months from the date of receipt of a certified copy of this order. With the aforesaid directions, the present writ petition is disposed of. JUDGE Indrajeet
