Respondents ORDER: In this writ petition, the petitioner is challenglng the ord. er dt. 16. 1o. 2025 passed by the 1"t appellate authority, disposing of the appeal by obserwing that the 3. d respondent has already furnished the information sought for, that is available in the office, as illegal and aibitrary. 2. According to the learned counsel for the petitioner, petitioner fiIed an RTI application before respondent No. 3 seeking to provide digital geospatial data' and the Assistant public Information \ \ \ officer (APIO) has informed. that during the suryey, the geospatiat co-ordinates are not recorded and therefore, the requested information cannot be furnished. He further submitted that I there is a provision of Appeal before the state Information commission and the petitioner has not availed the same. 4- Learned counsel for the petitioner, however, submitted that survey was conducted using GPS enabled devices and therefore geospatial co-ordinates would be available and the reason given by PIO is not correct. 5. since the 1st appellate authority does not seem to have considered the contentions of the petitioner, the impugned order dt. 16. 1o. 2o25 is set aside and the matter is remanded to the l"t appellate authority for re-consideration and passing of appropriate orders- 6.
