VIIAYSEN IUSTICE REDDY WRIT PETITION No. Il 097 0F 2026 DATE OF ORDER: L3. 04. 2025 Between: Panthangi Yadaiah and others Petitioners AND The State of Telangana, Represented by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others. ... Respondents ORDER: (ORAL) This writ petition is filed by the petitioners seeking to declare the action of respondents No.

2 to 4 in not considering their representation dated 03. 04. 2026 for protecting their rights in respect of the land admeasuring Acs. 0-02 guntas in Survey No. 32lA and Ac. 0-10 guntas in Survey No. 82lA, total admeasuring Ac. 0-12 guntas, situated at Lingampally village, Manchal Mandal, Ranga Reddy District, as being illegal, arbitrary and unconstitutional. 2. Heard Mr. K. Mallaiah, learned counsel for the petitioners; Mr. L. Ravinder, learned Assistant Government Pleader for Revenue, appearing for respondents No. l to 4; and perused the material on record. 3. Learned Assistant Government Pieader for Revenue submitted that this writ petition is not mairltainable. The petitioner has instituted a suit in ll O. S- No-188 of 2O23 against respondent No. 5 and revenue officials before the learned Junior ,3ivil Judge, Ranga Reddy at Ibrahimpatnam (for short 'trial Court') for decla. ration of title and perpetual injunction.

The relief sought by the petitioners must be pursued before the trial court; the mere pendency of their representation does not give rise to a cause of action for f,rling the present writ I petition. rl. i i l: 4. Learned counsel for the petitioners submitted that representation dated 03-04-2026 has been submitted by the petitioners requesting respondents No. 2 to 4 to protect their rights over the subject property pending disposal of the suit in O. S. No-188 of'2023. Respondent No. 5 who is defendant No. t in the suit is trying to alien:tte the subject property and create third party interest. Thus, this writ petition is maintainable. 5- As seen from the record, the petitioners filed suit in O. S. No. lgg of 2023 seeking declaration of tile and perpetual injunction. [t appears that the petitioners are not being granted any interim orders in the trial Court. The apprehension of the petitioners is that respondent No. 5 would create third party interest pending disposal of the suit.

Be that as it may, the same cannot be a ground to file the present writ petition as the petitioners have already invoked effective and alternative rem,:dy. i 6. In the circumstances, this writ petition is disposed of directing / I respondents No. 2 to 4, as the case may be, to issue prior notice to the petitioners as and when any application is filed for sale of the subject property so as to enable them to file necessary objections, if any by affording them opportunity of hearing. There shall be no order as to costs. : I i; As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
