IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6004 of 2020 ---- Jitan Munda @ Jitendra Munda. .. ….. Petitioner Versus The State of Jharkhand. …. Opposite Party -------- Coram: THE HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY -------- For the Petitioner : Mr. Prabhat Kumar Sinha, Advocate For the State : Mr. P. D. Agrawal, Special P. P. -------- 02/4-12-2020 Heard the parties. Defects, as pointed out by the office, are ignored. The petitioner apprehends his arrest in connection with Ramgarh P. S. Case No. 50 of 2020. Two truck were intercepted by the police and the trucks were found illegally loaded with coal. Although in the FIR, the petitioner has been described as driver of one of the apprehended trucks by the other persons but the petitioner denies such allegations. So far as the antecedent is concerned, the petitioner seems to have got a criminal antecedent of being involved in petty nature of offence as stated by the learned counsel for the petitioner.
However, since it has been alleged that the petitioner was the driver which was involved in plying trucks illegally loaded with coal, I am not inclined to extend the privilege of anticipatory bail to the petitioner. This application accordingly stands rejected. However, if the petitioner surrenders before the leaned court below within a period of three weeks and prays for bail, the learned court below shall make endevour to get the bail application disposed of preferably on the same day on merits without being prejudiced by this order.
