IN THE HIGH COURT OF ORISSA AT CUTTACK W. P. (C) No. 6927 of 2026 Laxmipriya Dash …. Petitioner Mr. Satyabrata Dash, Advocate -versus- State of Odisha and others …. Opposite Parties Mr. Debasish Nayak, Addl. Government Advocate CORAM: THE HON’BLE MR. JUSTICE MURAHARI SRI RAMAN ORDER Order No. 30. 04. 2026 01. 1. The petitioner claiming to be a landless and homesteadless person, approached the Tahasildar, Jatini (opposite party No. 3) by way of filing an application dated 12. 12. 2025 in Form-I prescribed under Rule 5(2) of the Odisha Government Land Settlement Rules, 1983 (“OGLS”, for short) (Annexure-5) for settlement of land. 2. It is submitted by Mr.
Satyabrata Dash, learned Advocate for the petitioner that after death of her husband, the petitioner has been facing much difficulty and came to know about the step taken by the Revenue and Disaster Management Department, Government of Odisha for providing appropriate land for the purpose of residence (information published by the Government of Odisha vide Annexure-4). 3. It is further stated that though ventilating her grievance, the petitioner has already made an application before the Tahasildar, Jatni (opposite party No. 3), the same is kept pending consideration till date. Under such circumstances, the petitioner prays that a direction may be issued to the opposite party No. 3 to take a decision on the above-mentioned application within a specific time period. No objection is raised for allowing such a prayer for consideration of the application, if the same is pending as on date. 4.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court disposes of the writ petition with a direction that the Tahasildar, Jatni (opposite party No. 3) shall take steps to consider the application in accordance with law and take a final decision on the application filed by the petitioner (Annexure-5), preferably within a period of three months from the date of receipt of copy of this order and communicate the result of such decision immediately to the petitioner.
