[2026:RJ-JP:36618] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 9392/2026 CNR: RJHC010667002026 | URN: CRLMB / 20456U / 2026 1. Bhanwarlal S/o Sh. Udmaram, Aged About 25 Years, R/o Sahwa, Tehsil Taranagar, Distt. Churu (Raj). (At Present Lodged In Sub Jail Nohar) 2. Ravi Kumar S/o Sh. Bhoop Singh, Aged About 27 Years, R/o Sahuwala 1, Tehsil Bhadra, Distt. Hanumangarh (Raj). (At Present Lodged In Sub Jail Nohar) ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Suresh Nehra For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 04/08/2026 Heard learned counsel for the parties, and perused the material available on record. The petitioners have been arrested in connection with FIR No. 239/2026 of Police Station Nohar, District Hanumangarh, for the offences punishable under Sections 8/21, 25 and 29 of NDPS Act.
They have preferred these bail applications under Section 483 of BNSS. Learned counsel for the petitioners submits that the alleged contraband 25 grams of heroine from Bhanwarlal and nothing has been recovered from the petitioner Ravi Kumar, the recovery is below commercial quantity. It is stated that there are no criminal [2026:RJ-JP:36618] (2 of 3) [CRLMB-9392/2026] antecedents against the petitioners and the petitioners are behind the bars since 27. 06. 2026 and 01. 07. 2026 and the trial is likely to take considerable time to conclude. Per contra, learned Public Prosecutor has vehemently opposed the bail applications. This Court has considered the arguments advanced by learned counsel for the petitioners and finds that the alleged contraband 25 grams of heroine from Bhanwarlal and nothing has been recovered from the petitioner Ravi Kumar, the recovery is below commercial quantity.
It is stated that there are no criminal antecedents against the petitioners and the petitioners are behind the bars since 27. 06. 2026 and 01. 07. 2026. Hence, keeping in view the overall facts and circumstances of the case; conclusion of the trial of the case is likely to take time; the narcotic contraband alleged to be recovered from the petitioners is below commercial quantity; the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case they are enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioners under Section 483 of BNSS. Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioner – Bhanwarlal S/o Sh. Udmaram and Ravi Kumar S/o Sh. Bhoop Singh, shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided he executes a personal bond in the sum of Rs.
1,00,000/- with two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of learned trial court for his [2026:RJ-JP:36618] (3 of 3) [CRLMB-9392/2026] appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
