IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 3833 of 2020 1. Md. Mustaqeem 2. Raj Kumar Das ... Petitioners Vs. The State of Jharkhand .... Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY Through Video Conferencing --- For the Petitioners : Mr. Sudhir Kumar Roy, Advocate For the State : Mr. Shekhar Sinha, P. P. ---th Order No. 04 Dated 08 December, 2020 Heard the learned counsel for the respective sides. The petitioners apprehend their arrest in connection with Pachamba P. S. Case No. 160 of 2019. It has been alleged that some tractors transporting illegally extracted sand were seized by the mining officials. The petitioner No. 1 appears to be the owner of the tractor bearing registration No. JH11T-3847. The petitioner No. 2 is the driver of the said vehicle. It has been submitted by the learned counsel for the petitioners that none of the petitioners have any criminal antecedent.
It appears that similarly situated co-accused persons being the owners and drivers of different tractors have been granted anticipatory bail by this Court in A. B. A. No. 1588 of 2020. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioners. The petitioners are accordingly directed to surrender before the learned trial court within four weeks from today and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih in connection with Pachamba P. S. Case No. 160 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands disposed of. (RONGON MUKHOPADHYAY,J. ) MK
