Mohanty, learned Additional Government Advocate for the State-opposite parties. 2. Additional affidavit filed by the petitioner in Court today is taken on record. In para-3 thereof, it states as follows: “3. That the Petitioner file this Affidavit with undertaking to complete the balance work “construction of H. L. Bridge over Jogiparitunda Nallah at 2/2-3 km on Ladiguda Jn. Palkakupakhal jn Road (ODR) under state plan” within a period of 6 months from the date of order in terms of agreement and will not claim escalation for the said period.
” 3. In view of such affidavit filed by the petitioner, this writ petition stands disposed of in terms of the averments made in the said Page 1 of 2 affidavit. It is, however, made clear that if the petitioner does not carry out the statements made in para-3 of the aforementioned affidavit and complete the work within the time stipulated, it is open to the opposite parties to proceed in accordance with law against the petitioner, as per the terms and conditions available in the DTCN. 4.
