JUSTICE RUMI KUMARI PHUKAN ORDER 20. 11. 2020 By this application under Section 439 CrPC, petitioners, namely, Minar Ahmed Talukdar and Rofique Ahmed, who were arrested on 22. 09. 2020, have prayed for granting them regular bail, in connection with DRI Case No. 05/CL/IMP/GOLD/DRI/GZU/2020-21 dated 22. 09. 2020, for commission of offence punishable under Sections 104/110/112/135 of the Custom Act, 1962.
Heard Mr J I Borbhuiyan, learned counsel for the petitioners and Mr B Sarma, learned Standing Counsel for the DRI. Also perused the record and the FIR. Page No. # 2/2 It is submitted by both the parties that the petitioner has completed the statutory period of 60 days behind the bar. The learned counsel for the DRI has also submitted that the offence report has also not been submitted. Accordingly, the accused petitioners, aforesaid, are hereby allowed to go on bail of Rs. 25,000. 00, with two sureties each of the like amount, to the satisfaction of learned CJM, Kamrup (M), with further direction to the petitioners to cooperate with the adjudication, till filing of the final complaint.
