Impugned in this petition filed under Article 226 of the Constitution of India is an order and judgment dated 27. 04. 2021 passed by the Central Administrative Tribunal (hereinafter to be referred to as “the Tribunal”) in OA No. 461/2021 titled Abdul Latief Shah & Ors. Vs. UT of J & K & Ors. , whereby the Tribunal has quashed the order of suspension of the respondents dated 04. 03. 2021. 2.
Learned counsel appearing for the respondents submits that during the pendency of the petition, the Government has prematurely retired the respondents and, therefore, this petition has become infructuous. Statement of learned counsel for the respondents is taken on record. 3. In view of the aforesaid, as stated by learned counsel for the respondents that the respondents have been retired prematurely by 2 WP (C) No. 1781/2021 the Government, the judgment passed by the Tribunal has become ineffective and this petition has been rendered infructuous. 4. The instant petition is, accordingly, dismissed along with connected application(s), if any, as having been rendered infructuous due to the subsequent development i. e. premature retirement of the respondents.
