S. -BORKHOLA DIST-CACHAR (ASSAM) VERSUS THE STATE OF ASSAM REPRESENTED BY THE SPECIAL PUBLIC PROSECUTOR WILDLIFE ASSAM ------------ Advocate for : MR H R A CHOUDHURY Advocate for : SPL PP WILDLIFE FOREST ASSAM appearing for THE STATE OF ASSAM BEFORE HON’BLE MRS. JUSTICE RUMI KUMARI PHUKAN :: O R D E R :: 18-12-2020 By this application under Section 439 Cr. P. C. , the accused-petitioner, namely, Sabir Ahmed Laskar has sought for bail in connection with Kaziranga Forest Range Offence Case No. KR 23/2020 under Section 39(2), 40(2)(a), 43, 48(a), 49(b) read with Section 2(2), 2 (31)(b), 49 A(a)(b) and 52 and punishable under Section 51 of Wildlife (Protection) Act.
Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, Page No. # 2/2 appearing for the State. Also perused the case diary and the materials on record. As per Preliminary Offence Report filed by the Forest Officials it reveals that the present petitioner was associated with illegal trading of rhino and he along with one another sold the rhino found in the Kaziranga Centaury in illegal manner for an amount of Rs. 4,50,000/-. The learned Special Public Prosecutor appearing on behalf of the Wild Life (Protection) has vehemently opposed the bail application on the ground that the petitioner being the forest employee has indulged such illegal trading of rhino is a serious concern and his further interrogation is required to unearth the complicity of other persons involved. I have also gone through the documents annexed.
Obviously, the offence is of serious in nature and as per the Assam Amendment of the Wild Life Protection Act the offence is punishable up to life. Considering the severity of the offence and complicity of the present petitioner, bail prayer stands rejected at this stage for the sake of investigation. In terms of the above, this bail application stands disposed of. Return the case diary. JUDGE Comparing Assistant
