By filing this petition under Section 439 of the CrPC, petitioner Putul Boruah who is in custody since 16. 01. 2020, has prayed for releasing him on bail in connection with Chungajan P. S. Case No. 03/2020, under Sections 376/ 511/371/294/506/34 of the IPC. Heard learned counsel for the parties and perused the case record. As per the allegation, the accused person took the victim girl in his vehicle with an assurance to drop her at Sarupathar to attend the computer class but she was taken to another place.
As such the victim girl apprehending his foul intention, returned to her home by another vehicle and has filed the case. Page No. # 2/2 Taking note of all the above, it can be inferred that the petitioner could not succeed in committing his evil design, what so ever may be. The accused person was arrested on 16. 01. 2020 and it can be inferred that further custodial detention of the accused person is not warranted. Considering all entirety of the matter and the nature of offence, the accused person named above is allowed to release on bail of Rs. 20,000/- with one surety of like amount, to the satisfaction of learned SDJM, Dhansiri, in connection with the Chungajan P. S. Case No. 03/2020. The bail petition stands disposed of accordingly. JUDGE Comparing Assistant
