Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and false allegations have been levelled against him. Co-accused- Gopal has been granted [2026:RJ-JP:37229] (2 of 3) [CRLMB-9579/2025] regular bail by learned trial court. Petitioner has been made accused merely on the basis of suspicion so also considering his past criminal antecedents. The petitioner has already joined investigation in compliance of the order dated 18. 09. 2025 passed by this Court. The mobile of the petitioner has already been recovered and no further recovery is to be made from him. The interrogation has been made and no further interrogation is to be made from him and thus, no fruitful purpose would be served by sending the petitioner behind the bars. Therefore, the petitioner may be extended benefit of anticipatory bail. 3.
Learned Public Prosecutor vehemently opposes the grant of benefit of anticipatory bail. 4. Heard the learned counsel for the parties and perused the material available on record. 5. Having considered the rival submissions, facts and circumstances of this case so also considering the facts that co-accused- Gopal has been granted regular bail; petitioner has been made accused merely on the basis of suspicion so also considering his past criminal antecedents; the petitioner has already joined investigation; and interrogation has already been made, in the considered opinion of this Court, no fruitful purpose would be served by sending the petitioner behind the bars. Thus, without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted. [2026:RJ-JP:37229] (3 of 3) [CRLMB-9579/2025] 6.
