JUSTICE GOLMEI GAIPHULSHILLU 23. 05. 2024 Heard Mr. M. Hemchandra, learned sr. Counsel appearing for the petitioner and Mr Y. Daljeet, learned counsel appearing for the respondent no. 6 and Mr. Y. Ashang, learned PP appearing for the State respondent. At the bar, learned counsel for the petitioner as well as learned counsel for the respondent no. 6 submitted that they have filed two agreement dated 26. 04. 2018 (between Smt. Thongam Mina Devi and Shri. Sagolsem Ratan Singh) and dated 26. 04. 2018 (between Sagolsem Ratan Singh and Thongam Ajat Singh) respectively before the learned Trial Court for consideration of the agreement and to dispose of the case on the basis of the agreement. However, the Ld. Trial Court kept the matter pending without considering the agreement filed by the parties.
Learned counsel for the parties further submitted that the case may be remanded back to the Trial Court for consideration of the agreement and also to dispose of the case as per the agreement. In the fact and circumstances, it is directed to send the case record to the Trial Court and the Trial Court is directed to dispose of the agreement submitted by the parties as per law as soon as possible. The parties are directed to approach the Trial Court as soon as possible. Accordingly, the present case is disposed of.
