Serial No. 04 Supplementary List HIGH COURT OF MEGHALAYA AT SHILLONG MC Tr. P. (C) No. 4 of 2024 in Tr. P (C) No. 2 of 2024 Date of Decision 16. 10. 2024 Smti Listra Nongrum … Petitioner(s) Versus New India Insurance Co. Ltd. … Respondent(s) Coram: Hon’ble Mr. Justice H. S. Thangkhiew, Judge Appearance: For the Petitioner(s) : Ms. A. Rani, Adv. For the Respondent(s) : Mr. S. Jindal, Adv. with Mr. I. Kharmujai, Adv. i) Whether approved for reporting in Yes/No Law journals etc. : ii) Whether approved for publication in press: Yes/No (ORAL) 1. This matter has been referred to this Court by the Hon’ble Chief Justice on the administrative side, which concerns a matter that had been transferred from the Judge/Member MACT, East Khasi Hills Shillong to the Judge/Member MACT, Ri-Bhoi, Nongpoh for disposal. However, on the same having been taken up by the Judge/Member MACT, Nongpoh, and extension had also been granted by this Court vide order dated 01. 10.

2024, for disposal of the matter, the learned Member, MACT, Nongpoh has expressed her disability to take up the matter in view of the fact that her daughter, who is a counsel, is attached to a senior colleague appearing for the claimant. 2. It is noted that the earlier transfer from Shillong to Nongpoh Court on the recusal of the Judge, MACT, Shillong had been directed by an order dated 02. 05. 2024 passed by this Court in Tr. P. (C) No. 2 of 2024, though the counsels had no objections that the said Judge take up the matter. 3. As such, faced with these peculiar circumstances, the counsels for the respective parties today namely; Ms. A. Rani, learned counsel for the petitioner and Mr. S. Jindal, learned for the respondent have expressed their consent and have submitted that the integrity of the Officer (Judge, MACT, Shillong) who recused from the matter is not in question, and they have no objection if the same Judge takes up the matter. 4.

Considering the facts and circumstances of the case as it pertains on today, and as the matter is of 2009 vintage, for the ends of justice, it is directed that the records of the MAC Case No. 3 of 2024, as renumbered by the Nongpoh Court, be placed before the learned Member MACT, Shillong for disposal, immediately. 5. With the above directions, the matter accordingly stands disposed of. JUDGE Meghalaya 16. 10. 2024 “V.
