Sr. No. 7 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case: OWP No. 1602/2018 Shuban Lal Pandit and ors. …Petitioner(s)/Appellant(s) Through: Mr. M K Raina, Advocate. V/s State of J&K and ors. …. Respondent(s) Through: Ms. Monika Kohli, Sr. AAG. CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER 27. 12. 2024 01. A revenue revision petition came to be preferred by four persons, who are presently four petitioners in this writ petition, before the Financial Commissioner Revenue, J&K Jammu, in which the private respondents were Hamidullah Khan and Mohd. Shafi Khan, who are the respondent No. 4 and 5 in the present petition. 02. The said two respondents namely Hamidullah Khan and Mohd.
Shafi Khan came to seek transfer of the revision petition from Financial Commissioner Revenue J&K Jammu to Srinagar by making an application to the said effect which resulted in a direction by the Financial Commissioner, Revenue, J&K of hearing of the revision petition at Srinagar and directed the parties and the officials to attend as per said direction. 03. This direction left the petitioners aggrieved to come to this Court with the present writ petition the actual purpose of which was to ensure that hearing of -2-revision petition before the Financial Commissioner, J&K takes place at Jammu where they had actually filed the revision petition and not as per the convenience of respondent Nos. 4 and 5. 04. Given the short controversy, this Court directs Financial Commissioner J&K to conduct the hearing of the revision petition filed by the four petitioners at Jammu keeping in consideration the fact that the petitioners are Kashmiri Pandit migrants. 05.
The writ petition is, accordingly, disposed of. 06. Copy of this order be forwarded to Financial Commissioner Revenue J&K for notice and compliance. (RAHUL BHARTI) JUDGE Jammu 27. 12. 2024 Sunita/PS SUNITA KOUL 2024. 12. 31 17:46 I attest to the accuracy and integrity of this document
